1) Acceptance of This Agreement
By using our website, requesting a free on-site estimate, or hiring J&K for services (collectively, the “Services”), you agree to these Terms & Conditions. If you do not agree, do not use the Services.
We may update these Terms from time to time. Changes are effective when posted with the updated Effective Date. Your continued use of the Services constitutes acceptance.
2) Eligibility
You must be at least 18 years old and authorized to enter contracts for the property where services will be performed.
3) Estimates, Scope & Change Orders
Estimates: Written estimates describe the scope, assumptions, and exclusions. Estimates are not binding until accepted in writing (including email/text) and any required deposit is paid.
Client Provides Paint: Unless otherwise stated, clients provide paint (brand, color, sheen). J&K provides prep and standard materials (masking, tape, paper, caulk, patching compounds, primers as needed).
Color/Finish Responsibility: Client is responsible for correct color codes/finishes. We recommend samples before full application. Color perception can vary by lighting/surface.
Changes: Any added work or deviations from the estimate (e.g., additional rooms, repairs, trim upgrades, specialty coatings) require a written change order and may affect price and schedule.
Hidden Conditions: If we discover unforeseen conditions (e.g., rot, moisture, mold, deteriorated substrates, prior coating failures, lead-based paint, asbestos, wiring/plumbing issues), we will notify you with options and pricing. Work may pause until approved.
4) Scheduling, Access & Site Conditions
Access: Client will provide safe access, power, water, and clear work areas. Remove fragile/valuable items and declutter surfaces/walls before scheduled start.
Protection: We protect floors, fixtures, and furnishings in the immediate work area using standard coverings. We are not responsible for pre-existing damage or items left in unprotected areas.
Delays: Weather, material shortages, client delays, or unforeseen conditions may affect scheduling. We will communicate changes promptly.
5) Payments, Deposits & Invoices
Deposits: A deposit may be required to secure scheduling and procure materials other than paint (if applicable). Deposits are applied to the final invoice.
Progress Payments: For multi-day or multi-phase projects, progress payments may be invoiced at milestones or weekly.
Final Payment: Due upon substantial completion. Substantial completion means work is complete except for minor punch-list items that do not affect use.
Late Fees: Past-due balances may incur a reasonable late fee and recovery costs as permitted by law. We may suspend work for non-payment.
Refunds: Services are custom and labor-based; except where required by law or expressly stated, all sales are final.
6) Materials, Prep & Paint
Included: Standard prep (light patching, sanding, caulking, masking), primers as needed for adhesion/coverage, standard sundries.
Excluded by Default: Structural repairs, extensive drywall replacement, stain/odor remediation, mold remediation, lead or asbestos abatement, specialty scaffolding/equipment, custom carpentry unless specified.
Cabinets/Trim: Cabinet and fine-finish work may require special prep and curing times. Handle with care during cure period.
Client Paint Storage/Disposal: On request, we can label and leave touch-up cans. Disposal of client-provided leftover paint is the client’s responsibility unless otherwise agreed.
7) Safety, Environmental & Lead Paint
We follow reasonable safety practices and comply with applicable regulations.
For homes built before 1978, lead-safe practices may be required. Lead or asbestos abatement, if needed, must be performed by licensed specialists (additional cost).
8) Photos & Portfolio
With your permission, we may photograph completed work for our portfolio/marketing. We do not display your street address or identifying details.
9) Warranty (Workmanship)
Labor Warranty: We provide a 1-year workmanship warranty on interior and exterior painting labor from substantial completion, covering peeling or blistering due to our prep/application.
Exclusions: Damage from moisture intrusion, leaks, structural movement, abuse, normal wear, weather extremes, substrate failure, or client-supplied product defects; horizontal surfaces exposed to standing water; surfaces previously failing; hairline cracks; color matching/fading inherent to coatings.
Remedy: Our obligation is to repair the affected area (prep and repaint) using reasonable color match. This is your exclusive remedy under the warranty.
10) Client Responsibilities
Provide accurate project information, color approvals, and site access.
Keep pets/children away from work zones.
Review progress and provide timely approvals or punch-list items within 3 business days of substantial completion.
11) Communications (SMS/Email/Calls)
By submitting your phone number or email, you consent to receive messages regarding estimates, scheduling, updates, and service reminders.
SMS Terms: Message/data rates may apply. Frequency varies. Reply STOP to opt out; HELP for help. We do not sell your phone number.
12) Intellectual Property (Website)
All website content (text, photos, logos) is owned by J&K or our licensors. You may not copy or reuse content without permission.
13) Third-Party Links
Our website may link to third-party sites. We are not responsible for their content or practices.
14) Disclaimers
Services and website content are provided “as is.” We disclaim all implied warranties to the fullest extent permitted by law, including merchantability and fitness for a particular purpose. Job outcomes depend on substrate condition, environment, and client-selected products.
15) Limitation of Liability
To the fullest extent allowed by law, J&K will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim shall not exceed the amount you paid J&K for the specific project giving rise to the claim or $100, whichever is greater.
16) Indemnification
You agree to indemnify and hold J&K harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the Services, except to the extent caused by our gross negligence or willful misconduct.
17) Disputes; Governing Law; Arbitration
These Terms are governed by the laws of the State of New Jersey. Any dispute arising out of or relating to the Services or these Terms shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Rules in New Jersey before a single arbitrator. No class actions. Each party bears its own fees unless the arbitrator awards otherwise. You waive the right to a jury trial.
18) Force Majeure
We are not liable for delays or failure to perform due to events beyond our reasonable control (e.g., severe weather, supply chain issues, illness, utility failures, acts of God).
19) Privacy
Your use of the website is also governed by our Privacy Policy posted on jkpaintingconstruction.com.
20) Termination/Refusal of Service
We may decline or discontinue work for safety, non-payment, or violations of these Terms. You are responsible for payment for work performed and materials procured up to the date of termination.
